‘Drug dealer’ learns why you don’t call cops when someone steals your cocaine

Apparently, one should not call the police if her/his illegal drugs are stolen. A self-described Florida drug dealer, found this out the hard way the other day when he called 911 to report a robbery. When the police officers showed up he told the responding deputy that someone broke into his car and took some money and about a quarter ounce of cocaine. The deputy then looked around the car and found some crack-cocaine and a crack pipe, and the reporting party was arrested on the spot. He is charged with possession of a controlled substance (cocaine) and resisting arrest without violence, which is inevitably going to cost him far more than just the quarter ounce of cocaine. We specialize in Colorado Drug Defense. Call our Denver office today for a free consultation at 303-635-6768.

Aaron Carter bragged about not getting a DUI before arrest

It is rarely beneficial to be overconfident when it comes to the law and our justice system. Aaron Carter, The less-successful brother of Backstreet Boys singer Nick Carter, was recorded on camera bragging that he will never get a DUI just five days before the Georgia police pulled him over and arrested him on DUI and marijuana charges. His girlfriend, Madison Parker, was in the car with him at the time and was charged with possession of marijuana and obstruction of law enforcement officers. Maybe the has-been pop star should have knocked on wood after he made such a bold claim. Or at least gotten somebody else to drive. The Law Offices of Steven J Pisani specialize in DUI, traffic, and criminal defense. Call our Denver office today for a free consultation at 303-635-6768.

Why Your Personal Auto Policy Doesn’t Cover Your Work Truck

Personal driving and business driving are two different risks that require two different insurance policies to protect your assets.

If you work as a contractorbuilder or painter, you probably use a truck to transport your tools and equipment between job sites. If the truck is registered to your business, chances are you also purchased a commercial auto insurance policy. But let’s say the truck you drive for work is also your personal vehicle. It’s registered in your name and covered by a personal auto insurance policy. You may think that policy also provides coverage for work-related use of your truck. But it probably doesn’t. In most cases, personal auto insurance policies exclude coverage for business driving. This could be an issue in No Proof of Insurance traffic tickets. Denver’s best traffic ticket defense lawyer can help sort this out.

Different Policies for Different Risks

If you read through your personal auto policy, it probably states that business use of your vehicle isn’t covered. That’s because personal auto policies are written with consumers in mind. Insurance companies assume that people who drive a personal vehicle are commuting to work or running errands, and they price the policy accordingly.

But when you use a vehicle for commercial purposes, you usually spend a lot more time behind the wheel. More miles spent on the road means a greater chance of an accident. From an insurance carrier’s point of view, business driving is riskier and more expensive, so it requires its own policy. And they aren’t wrong. According to the Federal Motor Carrier Safety Administration, accidents involving a commercial vehicle cost Americans $87 billion in 2011.

So, if you get into an accident while hauling tools to a worksite and you don’t have the appropriate commercial coverage, you could be responsible for:

  • Repairs for damaged property
  • Medical bills if someone was injured in the accident
  • Legal expenses if you are sued over the accident

If you don’t want to pay those bills out of pocket, it might be time to consider commercial vehicle coverage.

Protect Your Truck with Commercial Auto Insurance

Unlike personal auto policies, commercial auto insurance is a type of business insurance. Business policies address the risks of business driving, such as:

  • Additional time behind the wheel
  • The need to move tools and equipment between job sites
  • Transportation of employees or clients

Aside from covering business driving, commercial auto insurance is similar to your personal auto policy. A typical commercial auto policy may offer:

  • Liability coverage for damage you cause to a third party or their property
  • Medical payment coverage for bodily injuries you suffer in a crash
  • Physical damage, vandalism and collision coverage for your vehicle
  • Uninsured motorist coverage for damage caused by drivers who don’t have insurance

The medical expense coverage in a commercial auto policy can be particularly useful. If you’re involved in an accident that injures you or occupants in your vehicle, your policy may help pay for:

  • Emergency care
  • Diagnostics
  • Hospital stays
  • Rehabilitation costs

For example, let’s say you and an employee are en route to a client’s house for a painting job. You rear-end a car at a traffic light. If you file a claim under your personal auto policy, it may be denied. However, if you have a commercial auto policy, it may cover the cost of repairs to the vehicle you rear-ended, as well as medical expenses if you or your employee were injured. Contact the Best Denver Traffic Ticket Lawyer Steven J. Pisani for more information.

Worth noting: Commuting doesn’t qualify as business driving. If you get into an accident while on your way between your home and the office, your commercial auto policy typically won’t cover it. For better protection when you use a personal vehicle for business, consider purchasing both personal and commercial coverage.

Tiger Woods Says Medication, Not Alcohol, Led to DUI Arrest

Tiger Woods was arrested upon suspicion of DUI early Monday morning. Woods was reportedly driving “erratically, all over the road” when he was stopped law-enforcement sources told TMZ. As the officer approached he reportedly smelled alcohol coming from inside the vehicle. However, Woods states it was a bad reaction to his medications, and not alcohol, that caused him to drive so erratically. Woods refused a breathalyzer test on scene and was arrested for DUI. DUI’s are not just the result of alcohol; driving under the influence of any intoxicating substance can result in a DUI or DUID charge. There is plenty of confusion regarding legal blood concentrations of prescribed medications while driving.  The Law Offices of Steven J. Pisani specialize in the field of Colorado DUI, Denver DUID Defense, Traffic, and Criminal Defense. Call our Denver office today for a free consultation.

Your driving record may be more important than you think

New information reveals that insurance companies use your driving record to when determining risk. This is not news when it comes to your auto insurance premium, but it does come as a surprise to some that your driving record could be a factor in your Life Insurance and Home Owners Insurance policies. Based on 7.4 million vehicle records from 2006 to 2010 crossed referenced with death records from 2007 to 2010, companies found correlation between a person driving record and likelihood of death. For example, people with serious violations, such as DUI, had a 71% higher death rate than people of the same age with clean driving records or minor violations. In this digital age, your driving record is becoming increasingly important. If you are charged with DUI, Reckless Driving, or any other type of traffic offense, call our office. We can help keep your record clean. The Law Offices of Steven J. Pisani specialize in the field of Criminal Defense. Call our Denver office today for a free consultation.

Mass. Court Rules that Black Men Fleeing Police is Reasonable

The Supreme Judicial Court in Massachusetts has ruled that a documented “pattern of racial profiling of black males in the city of Boston,” makes an instinctive reaction to flee reasonable. “We do not eliminate flight as a factor in the reasonable suspicion analysis whenever a black male is the subject of an investigatory stop. However, in such circumstances, flight is not necessarily probative of a suspect’s state of mind or consciousness of guilty,” the decision reads. The law goes a long way to protecting common-sense reactions but fails in its scope. Why is this only limited to black males? Surely, given recent events of police shootings and unlawful civil forfeiture, everyone has an instinctive reaction to flee. Earlier, this office wrote a blog about a woman who had plead guilty to Felony Possession of a Controlled Substance after a flawed roadside chemical test read that her Advil was Crack Cocaine. Surely she now has an instinctive miss-trust of police. How about the Police in Mesa County who used a S.W.A.T. team to raid the wrong house? Surely that family has reason to flee from the police. The decision is a step in the right direction but is flawed and inherently racist. All peoples should have this protection. Fleeing the cops should not be used to demonstrate guilt or for reasonable suspicion that criminal activity is afoot. The Law Offices of Steven J. Pisani specialize in the field of Criminal Defense. We know that not all cops are out to protect society. If you have been wrongfully charged with an offense don’t hesitate to give our office a call.
